Like it or not, but I think Drake's song is protected by the 1st Amendment as it falls under parody fair use (A.I. 2 Pac) which is a protected form of expression. Its why Weird Al Yankovic was able to make his songs and why sketch shows like SNL can do what they do without legal ramifications. Like Quake said, Drake isn't monetizing the song and its clearly stated that the voice is A.I. You can't copyright a voice, only their artistry.

You’re actually wrong, in terms of Drake making money to distribute the song. Money doesn’t have to exchange hands. Tupac’s likenesss, voice, and IP all falls under PUBLIC PERFORMANCE RIGHTS. Which Instagram is. The song, is being replayed publicly, on a public platform, where advertisers pay for space. End of discussion. They can sue him into oblivion with that alone. I know this for a fact, not just from going to school but I sampled Dizzy Gillespie a few years back and ended up paying 8,000 for a single word of his band mates that made it into the mix. The lawsuit was based on a public performance, where I had previewed the song on my Facebook. You really need to cover every base if you’re gonna try to explain some complex shit like that. Some vague “maybe, maybe not” just isn’t gonna cut it.
