I think one of my hardest lessons this year was learning the harsh reality of who cares and who doesn’t. It’s heartbreaking to realize people who you thought were your friends really only care about themselves at the end of the day. It’s bittersweet cutting them out of your life though because part of you is proud of sticking up for yourself, but its also quite lonely. The people who hurt you just continue their life as if nothing happened and because of their guilt they twist the story. You are left with all the pain but you also learn a valuable lesson. We learn to see the ones that are authentic around us and to be able to appreciate them. I like to think that’s its not the amount of mistakes that we make in life that define who we are but how we go about fixing and learning from them that does. Those who pretend that what they did wasn’t wrong, are limiting their own growth.

Please don’t think it’s too late to take legal action, in no way this was your fault. It’s actually horrible how people can turn on you after they’ve done you so wrong. We support you Jeff.

Jeff dude, you're making a huge mistake. Many believe lawsuits are greedy and selfish and sometimes that's true, but often it's not. In your situation it isn't at all. What happens if this injury prevents you from being able to work and make money down the line in a way you're not realizing now? What happens if you develop early onset dementia or some other chronic, debilitating condition down the line? What happens if the lights completely go out in that eye? You can't rely on the kindness of people, you need to get financially compensated for this to protect yourself as much as you can from those what if situations. It can also helps to have the injury recorded on the books (legally) in a way that shows that your own negligence isn't solely the cause of the incident.It can help you maintain insurance coverage, and enable you to take advantage of other things down the line. It's not about being a man or not. Only fools keep their word to cheats and snakes, he's proven to be both of these. Take care of yourself.

Hi Jeff, I am finishing up my last semester of law school and I urge you to find a lawyer and at least consider your options. In my opinion, this could be a slam dunk especially because you have the footage of him repeatedly asking you to do his stunt, you have (hopefully) the records of his promise (better if its written) to pay your hospital bills, a large number of witnesses during the incident, that he knew he did not have the training necessary to operate that machinery, and was aware of the extreme danger he was putting you in for the sake of a video. Not to mention the emotional distress and life-threatening physical damages you experienced, and that you were prevented from getting a loan to purchase a house due to his refusal to continue paying for your hospital bills. And the footage of the documentary where he shifts the blame to you doesn’t hurt your case either. At the very least its gross negligence in a civil case and assault & battery in a criminal case. I could understand choosing civil vs criminal if you want to avoid David’s possible deportation or jail time. But you also have the option of pursuing both cases. Because of the high publicity surrounding the incident, a favorable judge (if your lawyer is able to forum shop) would likely want to make an example in order to deter other high profile content creators from escaping accountability for their reckless decisions. On the other side, David might use your filmed consent to going on the crane but you likely have overwhelming evidence to counter his claims. David will probably have a team of lawyers but I wouldn’t give up the fight especially if CA statute of limitations may prevent you from taking action against him later. For legal reasons, this is not legal advice but simply giving out information 😊
