Speaker: Jason Scott Textfiles.com
In a world where scams are now considered as commonplace as functioning websites and cell phones, it's sometimes too easy to forget the insidiousness and complicated preparation that can go into a well-honed misleading attempt to gain financially from unknowing people. It also helps if you're this side of crazy. For over a decade, Jason Scott (and a group of others) were plagued by one such artist of misdirection, and he will present an dismaying, tragic, but hilarious recounting of what he learned along the way and what you yourself might find yourself confronted with as you go about your business. The story is true, the two billion dollars was demanded but not awarded, and the case got to court. Come hear a legal yarn with a side order of fried conspiracy theory, and walk away a little wiser.

14:25 The statement he makes is very true. Happened to me when I was 16. Was in a car accident that was clearly not my fault. Police report said it was not my fault. All fault placed on the other party. They hired a lawyer who harassed my family and I for a year saying they were going to sue us, that we had done wrong, that there was legal precedent we should give them money. Don't fall for this or take it to heart.
@edlingja1
@edlingja1 7 років тому
JT Al Oh yeah, you just go to court when summoned and tell the truth. People will hold lawyers above your head like it's a special perk, but if you didn't do anything wrong, you don't have to worry. They may try to perjure themselves hoping you won't call their bluff; but any amount of critical thinking will show their fault. Thus the case will fall through and you don't even need a lawyer to allege perjury.

Had similar issues. Demanding further valudation - without proferring any additional info - usually works though, as you say. You might appreciate the story of LastWeekTonight buying a deal of "bad debt" in the US, mainly healthcare-related, then writing all of it off. Radio 4's In Business had a near-identical story some years back, where a crowd-sourced group did the same thing. Listening to the three-way chat between Peter Day, the crowd group rep & the guy from the debt collector's PR machine was priceless; the latter man was spitting nails at their business being undermined :) Debts need paying, but economic vampirism is deplorable.
@Studio23Media
@Studio23Media 4 роки тому
In America, if a debt collector contacts you, you have 30 days to ask them to validate the debt. They cannot contact you again until they can prove the legitimacy of what you owe. Often if it's a debt collector, they've bought unpaid bills in bulk and don't receive much of the information. There's always a chance it will disappear and there's no reason not to try.

@Ulkomaalainen
@Ulkomaalainen 5 років тому
Actually, don't inmates get the ability to defend (or sue) stuff in court unrelated to the reason they're in? Because that's something they should be able to. Of course not in a "just go there and come back" way, and of course somebody would need to check the application for being valid, so couldn't apply in this case, but "generally" I'd say this privilege exists.
@seditt5146
@seditt5146 5 років тому
@@Ulkomaalainen There is no validity check as no one would have the rights to view their legal mail other then their lawyer which in this case the guy was representing himself. Yes they have all the legal rights any normal person has in jail to sue.... defend etc.... Its to the point legal mail is regularly used to smuggle stuff into jail as no one really has the right to inspect packages completely so small amounts of contraband are smuggled in that way.

The advice to talk to people, to get others views, are so utterly critical! You need to consult friends and other people! You really do! I got sued by a scumbag on fabricated charges, I did not have supporting people around my, and that was tough. You have trouble defending yourself, alone. Wisdom: stand against bullies by having people with and around you, seek help and others will help. A cloud is just a remote server you're uploading data onto... Whether said data is privately available or not doesn't change what it essentially is. :)

@InjectorGadget

qazwsx edcrfv No, FTP is an FTP service. To keep things simple, cloud computing is storing and accessing data and/or programs over LAN or a WAN. How you access them depends on specific needs. FTP would be ONE way to access the data, another way would be SSH, or using HTTP (via your browser) to use a program stored on the cloud, etc.

Those shovelware guys might have been profiteers, but I have to admit their shonky, leeching work was much appreciated amongst the large population of us in the early-mid 90s who had computers with CDROM drives and nearby stores with budget/shareware software racks, but no modem or other BBS/network access. Got a lot of useful or at least interesting software and somewhat diverting games out of them. However, you're welcome to your opinion, and I'm about as thankful for your own service with Textfiles as that's a site I've also got many hours of use out of. It's an exceptional piece of work and the time you put into it is appreciated.

This is all of the awesomes all in one awesome. In the mid-90s this flavor of crazy was just getting organized. In 1999, someone produced a great resource called "Idiot Legal Arguments" -- the person's name is B. Susskind. I mention that because there are mirror copies of it floating around the internet that would still be up even when the original or an official mirror is not available. Despite the snarky name, it is/was actually a very valuable resource for attorneys representing people like you back in those days. It contains an exhaustive list of just about every crazy nutjob almost-sounds-plausible-if-you-huff-paint legal theory that has been presented in court, PLUS actual researchable case citations, plus brief summaries of the holdings. It is a soup-to-nuts encyclopedia of everything from "If the courtroom has a flag with a gold fringe, that means it only respects Maritime law and is not a proper US court of law" to "because Ohio was not actually state when the 16th Amendment was ratified in the late 19th Century..." followed by either "the Income Tax is unconstitutional" or "President Taft, who fraudulently claimed to have been a natural born US citizen (because he was born in Ohio) was not lawfully the US President when he signed the act that established the Income Tax" And both of those claims are sorta almost true, if you're a kook. There are also a variety of claims similar to those you describe as being in the Federal Zone -- all of which had been shot down by US courts probably long before any of your issues started. Many of these arguments are so radioactive in courtrooms that even mentioning the theory -- like mentioning the gold fringed flag in the courtroom -- will get you sanctioned by the judge for making frivolous claims. Interestingly, it's not going to be possible for any litigant to be deemed "vexatious" by a court on the basis of a single kooktabulous lawsuit. It takes several. And they have to be actually "frivolous" (not just "retarded", but "having no basis in law or fact", which is a specific legal standard. I can sue you because your hat is an eyesore and caused me medical expenses, and that might not be a frivolous suit -- there's a format for making out "He did a thing he shoulnta did, and it caused me to get up in my hurts" that essentially lays out the "basis in law and fact" of the claim. It won't *win*, because no jury is going to impose on you a duty to wonder who might be freaked out by the color of your hat. But it's not frivolous. Frivolous is like using the private attorney general dodge (shot down in flames multiple times over the last many decades) as a means of claiming a right to sue law infringers on behalf of The People -- but in a situation where there is no actual statutory basis for that kind of lawsuit. Private AGs come up legitimately when a state government creates a public cause of action (giving the government a right to sue) but makes clear that it's not going to be done by the State AG's office. An example is a California law establishing $500 damages for selling a used mattress that does not bear a yellow product tag. There's no defense to the claim: You sold it without the tag or you didn't. If it didn't have the tag, the purchaser has the right to sue you for $500 on behalf of the people of the state of California. As you can imagine, there are people who aren't attorneys who cruise flea markets and garage sales looking for mattresses for sale. A similar situation allows a handicapped person who is unfairly burdened by a public accommodation (restaurant, hotel, bar) that doesn't have access ramps for wheelchairs. There, the statutory damage award is something like $2500 to $5000. And there are people in California who make a living looking for restaurants to sue. They have to actually go to the restaurant and attempt to get service, and lots of these attempts fail because the restaurant will have some grandfathered-in exception based on the age of the building, or will have some marginally-satisfactory accommodation that still sucks ass but is just enough to defeat the claim by the "Private AG". (In part the confusion is jsut that "attorney" means "someone with a legal right to take legal action on someone else's behalf". A person acting under a power-of-attorney executed by a now-invalid family member can be referred to as an "attorney-in-fact" -- because of the piece of paper that grants them that power. I, on the other hand, am an "attorney-at-law" because there is a court order by the California State Supreme Court that has granted me this status -- and the CA State Bar Association that presented me to the Supreme Court (All on paper, I didn't do my swearing in at the CA SC. I had a friend of mine who is a criminal prosecutor swear me in after about our fifth or sixth beer commemorating the occasion. It counts just the same though.) I am licensed to practice in California as a matter of law. It's only by strange set of occurrences that I'm actually doing tech support for a very nerdy company that pays me a fair bit more than an entry-level lawyer would make in Calif.)

@sentralorigin

what is banach tarski lawsuit
@LetztezBatallion
@LetztezBatallion 7 років тому
It comes from the Banach-tarski gemoetric paradox, which basically tells you that you can, from a single object, create 2 other objects identical to the first one. THis is a REALLY simplified explaination of it,. so just google the thing. Like taking a rubik cube, dissasemble it, and then create 2 cubes identical to the first one.

I don't understand what this concept has to do with a lawsuit or the video

Honestly, despite his bombastic attitude when presenting, well - anything... Jason is actually a really down-to-earth, kind-hearted guy. I had the incredible opportunity to go have dinner with him at this one bar in Stockholm some years back when he was in town to give a talk, and it was honestly one of the most moving evenings of my life. For the record, and I give him no end of credit for this, dude doesn't drink; I had my fair share of beers, while he was happily pulling on a Coca-Cola, just expounding on story after story. Amazing dude.

Wow, this was quite informative! Not to say I've been served or had any worries of being so, but this really paints the picture of what I had already known; this country has seriously degenerated into mushy, puddy-like figures who cry at the first sign of danger or mistreatment, who become petrified at the slightest confrontation, and cause other more strongly willed people to lose their cool!

Funnily enough I've run up against the milder, more subtle form of this kind of crazy before in my career and, whilst it wasn't anything quite as mad as demanding $2bn, I can certainly vouch for the advice being genuine - talk it over with other people and seek qualified help if it starts getting bad (they can only tell you to go away after all). In my case having a union to help out on the professional side, and grounded friends and family to act as a sounding board and check that I wasn't actually the one going mad was a great help.
