The parents have stated that from the time he was 10 he was socially inept and at age 11 he tried to commit suicide for the first time. I think the parents did have an idea that he was mentally ill. His father was a scientist with degrees from Stanford and the mother was a registered nurse. I find it somewhat hard to believe that these two very smart capable people had NO idea about their son.

She took him to get help with social issues. There was NEVER a point she knew he had any homicidal or any other violent thoughts. The psychiatrist at grad school even called her the month before the shooting and didn’t say a word about his admission of homicidal ideation. If you take the time to research the case thoroughly, you’ll learn quite quickly that your statement here is not remotely accurate.

I am not taking about his diagnosis of schizo-effective disorder after the crime was done, I am talking about the legal aspects of the crime at the time of the shooting. James knew to fully protect himself at the time of the shooting, did not shoot at children and elaborately planned the shooting with detail schematics in his journal: that is why the jury did not find him criminally insane at the time of the shooting. No doubt, he suffers from mental illness, but I was talking at the time of the shooting and the legalities of the crime accordingly to the law.

From what I understood from the insanity plea is that there are very different criterial diagnoses that 'forensic' physiatrists must follow compared to that of just as an outpatient bases, without having the patient commit a crime during a mental or psychotic break. The insanity plea did not fail him as you make reference to: he simply did not meet the criteria for the plea as James 'at the time of the crime' knew fully well what he was doing was wrong, hence not directly shooting at children, hiding guns under blankets on route to the theatre and fully fatiguing himself in gear, knowing that a shoot out with police might ensue from the direct result of his planned attack. That is why the jury did not have problems finding him not criminally insane at the time of the shooting, as the prosecution clearly outlined their case to the jury. I agree, he has a mental illness and has been opined into being diagnosed as having physio-effective disorder, but that does not matter for an insanity plea.: 'knowing from right or wrong' at the time of the alleged crime was commissioned. James Holmes, in all likelihood, would have been sentenced to death, but one juror had issues with the death penalty in general and was there to save his life from the beginning.

purplepeace59 no, the criteria for mental illness and diagnoses are very different in the forensic field and criminally speaking, compared to that of just private practice of treating mentally ill individuals, who do not commit violent crimes. There are caveats in the DSM version 5, (the diagnostic and statistical manual) where it is outlined for professionals to diagnosis individuals differently when a criminal act has been commissioned.
