agreed. they need to stop analyzing criminal sanctions as a "damned if you do, damned if you don't" scenario. can anyone even remotely imagine a scenario where the courts an media are hand-wringing about applying the criminal laws to a flagrantly out of control BLACK offender because "he's just taunting the judge" or "he'll fundraise off it" or "his supporters could get violent"? no criminal sanction is even constitutionally VALID if the sanction is determined by factoring in the potential response by the offender to those sanctions. if the court doesn't star5 treating him like any other defendant, he WILL win on appeal any ruling the judge makes. the criminal justice system has to stop approaching this criminal defendant like this is a game of chess with a worthy adversary. he's a common criminal.
