Місяць томуScotland’s First Minister has insisted he is “very proud” of new hate crimes laws which have just come into force, as author JK Rowling warned the legislation is “wide open to abuse”.
The Harry Potter author, who has become a fierce critic of the Scottish Government’s stance on transgender rights, has been one of the highest profile critics of the legislation.
The Hate Crime and Public Order (Scotland) Act came into effect on Monday, consolidating existing hate crime legislation and creating a new offence of stirring up hatred against protected characteristics.
However, women have not been given protection under the law, with the Scottish Government instead promising to bring forward legislation to tackle misogyny.

My view is that "free speech" should not be invoked to justify "hate speech", where this is defined as actively promoting or endorsing harm to any group in society. So, for example, it is perfectly fine under free speech to claim that a trans woman is really just "a bloke in a dress". However, if you start saying that trans people should be beaten up or even killed, then that is hate speech and should be illegal.

No, it wasn't offensive! He was just giving his opinion that there isn't enough diversity in top jobs in Scotland. I'm not sure that I agree with him, but, at any rate, he certainly wasn't promoting or endorsing harm to white people, so it wasn't hate speech. PS: If you think his speech was offensive to white people, then you have a bit of a dilemma. True, it might justify prosecuting Hunza under his own law, but that would require endorsing his new law! So, you might be able to get rid of Humza that way, but you would have to keep his new law!

It would be hate speech only if you promoted or endorsed harm to them because they were trans. There seems to be a big misunderstanding on this point! I fully support a law that imprisons someone who encourages other people to go out and assault or kill trans people. That should be a crime. I'm not sure that Humza's new law makes it a crime just to call a trans woman a man????

While I agreed with some action, just think what happened with Covid and how easily the public slipped into line for that.
