💬 The topic of Steam and AI has come up again, this time because a AAA game that is using AI has just landed on Steam
It's called THE FINALS and the developers are very transparent with how they are using AI voices during gameplay.
So is Steam now always allowing AI? Or is it simply the same reason as previously, is it simply a question to do with copyright.

Art, text, or music created by a computer cannot have a copywrite since computers are not granted copywrite protection by U.S. law.

Good and informative video, CM, even the title does seem a bit too clickbaity. Valve hasn't changed their stance it seems, and that's a good thing in my opinion. As for the two AAA games you mentioned, the devs of The Finals said they do have the rights to the data for the AI voices like you said, but High on Life is most likely a grandfather clause case, since that came out a few months before Steam's AI rule came into effect.

If you cant prove you own all rights to all data used to train an AI This game gets through because they own all of it as far as i am able to find out But plenty of games use open-source AI and do not own all rights nor ever have a licence allowing use of everything because plenty of copyright breaking stuff is used to train some AI

My guess regarding the voice thing - there are companies out there that specialize on this, but that is how James Earl Jones licensed to Disney his voice to allow creation of new vocals based on his voice. This + AI (including tech by NVidia) not only allow the changes in script later on, but also real time voice in games.

I'm impressed that no one has mentioned this yet, but I doubt Valve is going through every inch of the game to check for AI generated content. If your game has visibly AI generated art plastered all over with no original assets, it's probably going to get hit, unlike games like The Finals which are all original assets with just AI voices, and somewhat decent ones that are not that easy to spot. I think no one will know if you use AI to generate some text, song or texture, but if your whole game is basically an AI assetflip then you'll have a problem

It might be that valve just find it unlikely for indie devs to actually have the rights for training sets. It's easy to imagine that AAA-Studios have trained their AIs with assets from all their previous titles and artist. For indie devs I can hardly imagine the same to be true. I mean how many openly available AI-tools are there that aren't trained on random assets from the internet? Even ChatGPT had a lawsuit regarding some authors accusing it of using their books as training data.

you said it yourself Valve is banning games use AI-generated content that are questioned about there right of use I am no lawyer, and a problem for us indie that most of us can't afford lawyers Example if Rockstar takedown you GTA 6 video cause you are using clips from there video(GTA 6 trailer)are you ready to make a law battle against them?(and yes technically they can take down your video).So if I'm going to use Unity AI i simply tell Valve that in the TOS that i agree for using Unity AI said that the training is based on Data they owned and i put myself in the safe zone if Unity was Lying about this(for what ever reason)then this is not my problem.

Yup Rockstar could definitely take down my video on GTA6, they made the game they own all the copyrights to that footage. If they did try to take it down I would comply, I'm definitely not going to get into a law battle with a billion dollar company heh Unity said they would defend people in the case of lawsuits, Adobe said something similar, but as far as I know no one has tried that out yet so not sure exactly what legal procetion they provide

It's impossibile for anyone to understand if an assett is AI generated or not. This is a very big problem.

It's mainly for AI Art where steam enforces. If you do story they have no way of knowing. And for voice generators they have been in steam games for years. I guess probably all of those were trained with paid voice actors as you said.

I have a question, how does valve know there are AI assets in your project? So if we have an AI-generated Texture How do they find out?

The AI arts have the own art style. As shomene that makes my own art I'm able to tell Wich art is completely generait. As for other AI parts like voice text ECT I'm not that familiar One other thing if you use AI as tool like upscale for example I don't think I will be a problem.

@@watercat1248 but still it's not proof that you are using AI, there should be some evidence to prove you are using AI. Also, I'm talking about textures or even Text, The image like midjurney looks like everyone can guess it's AI. Idk it's just a little bit confusing :/

Some things are obviously AI generated (missing/too many fingers for example) But yes for a lot of things nowadays you really can't tell, so they only know if it's super obvious or if you tell them

Classic Valve sticking up for the small guys, except when there is the tiniest of risk of losing any money, then only AAA gets preferential treatment

Banning AI is like trying to ban FL Studio. That tool also made some professionals jobless, but that’s the march of progress. You still have to make your own stuff, you can’t just slap a Prince track in your game. The thing with many uses of AI is, that tracking the right and wrong ways of using that tool will be hard.

I don't know the details of the lawsuit, but my guess would be it got dismissed on similar grounds to how piracy works. If you watch a video that's uploaded to a piracy site, then you're not the one liable, but the host site would be since they're the ones with the ethical obligation to ensure proper licensing and you become a victim of fraud and misrepresentation. Similarly, it wouldn't be the individual dev who gets slammed for using AI art through a central repository, that'd be Midjourney's fault for using unlicensed IP. If that's the case of what happened, then basically it means you can't get sued for using tools that you, in good faith, have every reason to think are honest. The case would be dismissed for "lacking standing" meaning the other party can't come after you as they don't have a valid claim against you. Don't quote me on any of this, though.

@@flamart9703 The principle of "good faith" and "presumption of innocence" means we default to everything being above board until we have reason to suspect otherwise. Again, if the AI companies are claiming to do things ethically, then we should take them at their word until they're proven to be frauds. That's just a good way to go through life in general.

Question, how will Steam know that the game uses AI content if they don't talk about it? Or is it just the fact that it's being talked about that's the problem? Then, I also have another situation like this. I'm developing a game, and I'm also drawing artwork for it. I have a neural network that I have trained on my artwork to draw in my style, and of course the basic version of it is taken from the public domain. Question, if the art is in my style, and almost indistinguishable from my other art, how will steam know if it's my art or AI?

Basically if it isn't obviously AI art (too many fingers) and if you don't tell them then it's hard to anyone to know You question is that legal grey area, it sounds like you're saying you took something that was trained on a huge open source dataset and then fine tuned it on your own style, right now no one knows if that is legal or not.

Its now impossible to separate AI from most software. With AI tools being used to help write code, generate possible solutions, brain storming ideas, even search engines are AI It kinda feels like now that its being used so widely, on almost everything, its not going to be possible to separate what is AI and what is human.

​@@CraftBasti There's also problems with copywrite code being given by AI verbatim. But at least some AI now let you know if the code is patented, so your less likely to get sued when you use it :/ (note: if you ever want to be a programmer, do NOT search or look for patented code)

It's really interesting how Valve's check for AI-generated content works, especially in the case of voiceovers, as it could significantly simplify game development (I was just thinking of using a similar approach in my project and immediately recalled your previous video).

This is such a clickbait video, everything you explain here was already known fact many months ago. Steam never banned AI in the first place, you just need to show proof that you own the model or have the license for it.

Maybe you read the whole articles but most people just read the headlines, there were tons of people freaking out back then and those same people are now confused as to how The Finals is allowed on Steam. The whole reason why I made this video was because I saw exactly that same confusion on Reddit. So you might fully understand the issue but not everyone does.

@@CodeMonkeyUnity I think he means the title of the video, an "Is" at the beginning would prevent disgust. Many vloggers and journalists use this technique, to put a misleading claim in the title of their materials to attract more people, and with a question mark at the end, to avoid accusations of lying, but it is annoying for people who are looking for objective information and are tired of media tricks.

IP rights when generative AI is used is an interesting topic. I am fully on the side of prohibiting usage of other people's work without pay or consent. However, humans themselves don't just come up with things out of thin air. We always build upon something, upon some previous knowledge, use or are inspired by other people's work, to a larger or smaller extent. Does an artist that designs a spaceship in that distinctive retro-futuristic aesthetic of the Nostromo not get to sell their work because they don't own the Aliens IP, for example? Of course, a human taking inspiration from something is a big leap away from a tool like a neural network being trained with images of the Nostromo. But it seems to me like there's a line here that needs to be drawn, and it's not easy to figure out where. Saying "the line is drawn between human and machine" seems like a cop-out to me. We need to decide at which point does inspiration become plagiarism. We might be getting faced with this very old question again, this time with our technological future at stake, depending on the answer.

Well, you kind of said it yourself. Human beings are inspired to create - machines are told to do so. What we need more than anything (in my opinion) is a reliable way to detect ai-generated content, and laws requiring that such content be identified as such.

I'd argue every piece of art ever created by a human has stemmed either from nature itself or another piece of art, either intentionally or subconsciously. In which case, what makes AI any different? We humans were just trained on a lot more and more varied data

@@Hietakissa I don't think it's a matter of whether art is 'original' or not. It's human beings that give meaning to art - through our lived experience. A machine has no concept of meaning. It feels nothing. It's just putting pixels together as it has been instructed to do.

So Since Ignorance Is Bliss, apparently, enjoy not knowing whether or not you could have been one of the few Perfecters of our generation.... I hope the entire discussion about AI comes to a conclusion soon. Right now the less volatile solution would be to make art/sound created with AI free to use by anybody. So big companies will avoid using an asset that would be copied by thousands the very next day, but small indie devs will probably be fine with it if they can use decent art/sound for a fraction of the high cost quality art costs now. Having people copy art assets would act as advertisement for the game anyway.

I recently made a steam page in which the capsule art is AI-generated and I declared that in the review process. And they accepted, so I guess you don't need to prove you own copyrights as long as you don't get sued.

I don't get why AI is illegal. It basically learns from the existing artworks just like a normal artist does. If you put a human on an island and just provide the food and avoid artistic stuff that can inspire him/her. That person can not create the artwork we see in the games or everywhere! Do artists pay other artists when they look at their artwork and learn from it, inspired by it? No. Why does AI have to pay then?

That is indeed the legal question. As far as I know it is perfectly legal for me to hire a human artist (who learned on tons of paintings made by others) to do a copy of a Picasso painting. The argument that people make is the scale difference. A human learns from watching something like thousands of paintings, whereas an AI learns from billions of inputs.

@@CodeMonkeyUnity I understand that but if we look from that perspective, we should throw away our printers and let the old scribes write all the books by hand again! It is a similar thing since in both cases the production time and the quality of the product change. On the other hand, I want to protect the real artists who really create unique art. We should find a way to protect them and let the technology expand since it is inevitable.

The only thing I've used AI for is concept art...using one of those free text to picture AI websites...then i just sculpt or model my asset using the generated AI pic as a reference...ngl, AI comes up with some weird stuff sometimes tho...

Thanks for the update. From this, I take it that Midjourney would also be legal to use because midjourney owns all their datasets, and if you have a subscription with midjourney that also gives you a license for commercial use. Stability AI would definitely be the one to stay away from because it's open source.

Midjourney absolutely does not own the rights to their dataset. It's one of the main generators known for harvesting art without any kind of consent.
