We are not a democracy. We are a constitutional Republic. That means that the majority of a single state has no tyranny over the minority of smaller states. That’s one reason why each state has two US senators, the electoral college, etc, etc.

Time to boycott products made very specific areas of the USA that support MAGA. It is unfortunate that employees at many localities could suffer layoffs and financial problems due to reduced sales due to a boycott. The Supreme Court sites in their dissent a major force behind their decision to keep Trump on the ballot, and, that is because of the fear surrounding Trump's insurrection and the unstable state of our government, leaving it all up to a FASCIST CONGRESS to decide the outcome. This shows they ABSOLUTELY would have to cave in to Trump, and, to Trump's Congress if he regains power. Even though I am not voting for Trump, I do agree that it is not a state decision. States cannot just go rogue for the election of the President of the United States. As far as the the 14th amendment goes, I do think that it does imply that Congress would decide this and Trump was impeached for this but not convicted. The amendment said Congress could overturn this decision by 2/3 vote. It mentions nothing about conviction. This is not silly. This also needs to be addressed. It is a 2 part question. One part is answered. The other part has not been addressed by congress. They should also address gerrymandering. This also disenfranchises peoples right to vote in a Presidential election.

The 14th Amendment has more than one section. Section 1: "No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States..." Section 5: "The Congress shall have power to enforce, by appropriate legislation, the provisions of this article." "Shall" is a specific word in law. It means it's blanket and mandatory, no exceptions. "No state shall," means exactly that. It doesn't mean, "no state shall, unless they really, really, really want to." Section 5 CLEARLY puts execution of Section 3 in the hands the federal government. It's on the Congress to pass federal legislation to enforce Section 3. And who has jurisdiction over federal law? Federal prosecutors and the federal courts. NOT the states, even IF one could successfully argue that the opportunity to serve in federal office is somehow not a citizenship privilege. And Section 3 itself specifically assigns to Congress the option of waiving a disqualification. So. Congress, and no one else, is empowered to disqualify a person or group of people under Section 3; and Congress, and no one else, is empowered to make exceptions to said disqualification. The text appears to be sparkling clear here.

Not the courts, civil or criminal. Not the people. Historically none of those who have been barred were adjudicated in civil or criminal court of having done so, nor were they impeached for it by congress. It's a political matter and it is your peers in Congress that decide if someone who might seek office is barred from holding it due to am act insurrection or treason. There need not be any convictions or civil determinations in court or an impeachment. It is separate from any statute for Insurrection and treason it is simply a requirement for holding office just like age or other factors. And it is the politicians in Congress who decide that.
