The obvious issue is not whether one party can acuse another and place opposing candidates in jail...! The issue before the court ahould be solely on laws being broken. Did someone do nothing for over three hours while the capitol was being attacted resulting in death and distruction? Did someone suggest metal detecters be removed because they were not threating himself? SCOTUS should rightfully decide in a case by case basis, not whether one party is attacking another party - but whether a person or parties has conspired, directed and was complicent in a violent action. In the future SCOTUS may again decide on any specific issue brought. This is a slam dunk conspiracy to subvert, as 62 lawsuits agreed, a fair election. This obviousness of the former president accusing the rigging of elections goes back to 2012 !! This recent history lesson has eluded the Supreme Court...

@msnbc Justice Alito is very smart and his twisted logic in questioning leads to be think that Alito is verbatim reciting a talking point concepts from Federalist Society, possibly in collusion directly Alito-Leo.

I think that an official presidential act would include advice from all department heads provided to the president to assist in making sound and official decisions. In the case of the election denial the president was told by everyone that he was wrong and lost the election and there for all actions taken to stop the transfer of power were not an official act and thus against the law. The argument that the president could prosecuted after office for accidently make a mistake while in office doesn't really hold any weight if the president actually seeks advice from their advisors to make the best possible good faith decisions possible with the full support of their whole team.
