I believe this cop - polite tho he may be - violated her 4th Amendment rights when she was in her car. She suggested they go in the store and view video together since nobody claimed to have seen her leave without paying, but he said no, insisting that she instead show her receipt. He just had to show his domination, didn't he? Dragging her out of the car, mashing her face and arm against the tire, and frightening the kids, all because he was hellbent on searching so that he could prove there was no receipt. I'm sorry this happened to you, lady. He should have confirmed whether or not you paid. If the store video showed a theft, that would be the time to pursue a charge. However, the video showed you paying; the store managment, clerk and the cop owe you an apology. The narrator here said you were arrested and in the end also lost a case against the store and cop. THAT IS INCORRECT! Losing in lower courts doesn't mean you can't file a federal case for the constitutional violation of your 4A protected rights. Do it! I don't drink alcohol at all but I would still refuse a field sobriety test, which a person is allowed to do. It is easy for someone to "fail" a field sobriety simply due to being nervous or in very cold weather. I would insist on both a breathalyzer test and a blood test. That dirty cop simply wanted to be in control for as long as he could and to delay the inevitable. A cop always knows if they get sued, they will never personally be held financially responsible.
