I think it was Alito who asked about FDR's hard choice with the internment camps, that being held criminal may have weighed on his decision. PERFECT then he may not have done such a dumb racist thing... If an act is criminal then it's probably not in the best interest of the country - if it was, then (s)he could pardon themselves for the act and if it was for the best interest of the country then it would their pardon would protect against the criminality. That is such a corner case, the bigger worry is one party gaining control of one branch of the legislature therefore wrecking the impeachment process (as we witnessed in trump's impeachments) - allowing an criminal president to do what ever he wants.

The Supreme Court since Nixon, has been the legal protector of Our Presidents. They are basically in charge of ensuring Our Constitution is enforced which is the Law of the Land. Therefore after Nixon was Pardoned for crimes he committed while in Office even though those crimes were out of the scope of his duties as President, they were personal actions, so he was still facing the Law. No one is Above the Law, right? Anyhow both Parties created another Agency. This Agency was to from now on direct the DOJ on how, when, and on whom, to Uphold the Law. This Agency in order to shield any future Presidents of having to worry about being charged with crimes they may commit while in Office came out with a MEMO. In this MEMO it directed the DOJ to not bring charges on, or investigate a sitting President for crimes they may commit while in Office. Something to do with having to follow the Law and our Constitution may affect the President's ability to Govern. They did not give direction as to what happens after someone is no longer President. Rediculous and UnConstitutional I know, but both Parties have held up this rediculous MEMO as the Law, ever since. This is what Trump is arguing. No where in Our Constitution does it say that Our President is Immune from the Law. Just the opposite, the President takes an Oath to Faithfully Execute the Laws Congress has made. Congress makes the Laws of this Land, and they have NEVER made a Law that says Our President is Above the Law, while in Office, or at any other time. This direction in this MEMO is UnConstitutional and it is a direct result of a Madman like Trump being able to take advantage of it. Our Constitution starts with, "We the People" Not "We the Party" or "We the King" It starts with We the People. A President who is Above the Law is a Dictator, or King. Not a President. If our President is so Above the Law that they can overturn Our Democracy, and install a Dictatorship if they want, what have so many given their lives to protect and defend in all Americas years?
