I have been in law enforcement for over 30 years and I have learned that anytime a suspect says they have a attorney they definitely do not. Also if a female officer is not available a male officer can most definitely search a woman. If they say they know their rights they most definitely do not. You are not entitled to a attorney until you are arrested and come before a judge or before questioning.

My sister was a criminal defence lawyer for years & got plenty of out of hours phone calls from people arrested at all time of the day or night. Her standard response was Don’t say anything & I’ll speak to you during office hours. In other words your lawyer will not be attending the police station at 9pm or 2am for any reason unless you are some kind of special client. They will not be bailing you out or making deals with the cops on your behalf immediately after your arrest, they will almost certainly not be representing you in a future case against the police because you will almost certainly have no grounds to sue, especially as everything is now on body cam & CCTV. The police all know this which is why this overused threat to ‘call my lawyer’ is stupid and a waste of your time.

The former established the legal precedent allowing law enforcement to order drivers out of their vehicle in the interest of officer safety while the latter extended the former ruling to passengers. Odor of intoxicants is 100% probable cause for law enforcement to order occupants out of a vehicle. Failure to obey lawful orders given by law enforcement is called Obstruction - an arrestable offense. Actively resisting or otherwise being disorderly/uncooperative only serves to pile on the charges...
